Chapter 37: Terms of Reference – The Executive, Grants, King George’s

Terms of Reference of the following Executive Bodies are set out:

Cabinet

King George’s Field Board

Grants Determination Cabinet Sub-Committee

Housing Management Cabinet Sub-Committee

Section 37.1: Cabinet

Summary Description:The Cabinet is forum for the Mayor and Cabinet Members to take decisions related to the executive functions of the Council.

Membership:The Mayor and at least 2 and not more than 9 other Cabinet Members appointed by the Mayor.

Functions

Delegations

1) To discharge all functions not specified as the responsibility of the full Council or of any other Committee, where the Mayor has delegated his powers to the Cabinet as set out in the Executive Scheme of Delegation.

2) In relation to any executive function for which the Mayor has not delegated his powers to the Cabinet, to advise the Mayor on the discharge of that function.

3) To refer to the Standards Advisory Committee for consideration any report which contains implications for the Council's ethical framework

Quorum:3 Members of the Cabinet including the Mayor or, where notified in advance to the Monitoring Officer, the Statutory Deputy Mayor.

Part C – Decision Making

Section 37.2: King George's Fields Charity Board

Summary Description:

The original charity was set up following the grant of moneys from a national appeal to perpetuate the memory of the late King George V.

The foundation made grants for the laying out of the playing fields and it was agreed that they would be preserved in perpetuity as a memorial to King George V. The current King George’s Field Charity Board is a Cabinet Committee fulfilling the Council’s obligations as charity trustee. Currently the work is split into two charities, King George’s Field Mile End and King George’s Field Tredegar Square. Both are dealt with by the Board.

This covers a number of pieces of land including Stepney Green Park, Whitehorse Road Open Space, Tredegar Square and most of Mile End Park including Mile End Park Leisure Centre and Mile End Stadium.

This includes 10 shop units situated beneath the ‘Green Bridge’ at Mile End.

Functions

Delegations of Functions

1) To administer the affairs of the King George's Field, Mile End charity, registered number 1077859 and the King George’s Field – Stepney (Tredegar Square, Bow) charity, registered number 1088999 and discharge all duties of the Council as sole trustee of these charities.

2) To administer the affairs and discharge the duties of trustee of such other charities controlled by the Council as the Mayor might authorise.

Section 37.3: Grants Determination (Cabinet) Sub-Committee

Summary Description:A Cabinet Sub-Committee, chaired by the Mayor, established to consider matters relating to grants.Membership:Four Members of the Cabinet as appointed by the Mayor. All other Executive Members can substitute where necessary.

Functions

Delegation of Functions

1. To determine all applications for grant funding received by the Council that require a Member level decision where there is no specific delegation to officers

Various grants decisions have been specifically delegated to officers (see 3 below).

2. To determine all applications for corporate match funding received by the Council.

3. The Sub-Committee may delegate decision making to individual officers, provided that the extent of this delegation is made clear and that it is minuted properly.Delegations agreed by the Sub-Committee will be listed at the bottom of the Terms of Reference in respect of decisions from May2021

4. Where decision making has been delegated, to receive a report advising as to the exercise of a discretion at the next Sub-Committee meeting following the exercise of such discretion.

5. To receive quarterly update reports against defined parameters in order for the Council to demonstrate either: that delivery is in line with the application and, therefore, the grant achieved its purpose; or to provide clear delineation where outcomes were not achieved and the reasons for such failure are apparent. Such Monitoring should therefore include measuring performance against the expected outcomes.

Section 37.4: Housing Management (Cabinet) Sub-Committee

Summary DescriptionA Cabinet Sub-Committee, chaired by the Mayor, established to advise on all matters relating to the delivery of the Council’s Landlord Housing Management function. With specific emphasis on ensuring the safety of residents living in Council-owned homes and ensuring residents shape service design and delivery.MembershipThe Mayor and three members of the Cabinet as appointed by the Mayor, to include the Cabinet Member responsible for housing management functions.The Mayor will take decisions on the advice of the Sub-Committee.All other Cabinet members act as substitute attendees in the event that the appointed members are unable to attend.Up to three industry expert advisors (“Independent Advisors”) to be appointed, on the recommendation of the Sub-Committee, to provide independent specialist support and advice around finance, compliance, customer services and asset management.

1. To oversee and advise the Mayor on the Council’s compliance with the Regulatory Standards, Building Safety Act and Fire Safety Act

2. To oversee and advise the Mayor on the Housing Management Strategic Risk Register

3. To review and advise the Mayor on the performance of all landlordhousing functions and the engagement of residents in the effective delivery of services.

4. To monitor and advise the Mayor on the impacts of investment in ensuring the Council maintains decent homes, fire and building safety and customer satisfaction, and ensuring the effective delivery of our Asset Management Strategy

5. To advise the Mayor on the approval of any strategies or policies relating to housing management functions that require a member level decision.

None

6. To advise the Mayor on driving and monitoring continuous improvement, service improvements and transformation programmes related to housing management functions, with particular regard to any improvements recommended by the Regulator of Social Housing and Housing Ombudsman.

7. To provide reports to the Council’s Cabinet, Mayor and to relevant Council Scrutiny Committees including the Housing and Regeneration Scrutiny Sub-Committee and Tenants’ Voice panel.

8. To receive reports in relation to compliance with the Housing Ombudsman Complaints Handling Code on the direction of the Cabinet Lead Member (who is the responsible member for the council’s adherence to the code).

9. To receive reports and consider recommendations produced from any internal and external audits and reviews, including those of Tenants’ Voice and Scrutiny Committees
